Overview

The Trade Disputes Act 1906 represented a landmark legislative victory for the British labour movement, fundamentally altering the legal landscape for trade unions. These judicial decisions had effectively undermined the ability of workers to organise and strike, placing union funds at significant risk of seizure and leaving collective bargaining in a precarious position.

In response to these challenges, the Act provided essential protections that restored the operational capacity of trade unions. By granting immunity from actions for damages caused by peaceful picketing and ensuring that unions could not be sued for inducing a breach of contract during a trade dispute, the legislation secured the right to strike in practice. This shift was a defining moment in the development of modern industrial relations, marking a transition towards the formal recognition of organised labour as a legitimate and protected force within the British economy.
